The Family Court of Australia was created in 1976, officially commencing operations on January 5, 1976. 

The Family Law Act 1975 transformed divorce and family law by introducing no-fault divorce and establishing the specialist Family Court to deal with complex family law matters of divorce, parenting and property disputes.

The Act reflected changing social attitudes and recognised the human, rather than purely legal, complexities of marriage breakdowns. Early years were difficult, with limited resources, resistance from other courts, and even violent attacks on judges in the 1980s, leading to increased court security and formality.

Over time, the family law system has continued to evolve. Significant reforms have improved responses to family and domestic violence, including the Lighthouse initiative and specialist lists such as the Evatt List for high-risk cases. The merger of the Family Court and Federal Circuit Court in 2021 created a single entry point, while COVID-19 accelerated digital hearings, greatly improving access for regional communities.

Family law cases are now more complex, often involving  family violence and coercive control, financial intricacies, and technology-facilitated abuse. We are aware of the ongoing challenges that the Court is facing, including  continuing delays and complex family dynamics.  Despite these issues, the Court’s focus on trauma-informed practice, safety, and dispute resolution has strengthened significantly over the years.
