Being a beneficiary of a discretionary trust doesn’t mean being entitled to a share.

A discretionary beneficiary generally has no fixed entitlement to the trust assets and cannot simply demand a distribution or insist on receiving an equal share. Their only right is to due administration within the meaning and spirit of the trust.

However, trustees still have obligations concerning the proper administration of the trust. An estranged beneficiary may, in appropriate circumstances, seek information about the trust or challenge the way it has been administered.
